Welcome to PixelHub. By using our website and software (pixelhub.me), you agree to these Terms of Service. Please read them carefully.

1. The Service

PixelHub provides an automated email marketing and pipeline management tool ("The Service"). We grant you a non-exclusive, non-transferable, revocable license to use the Service for your business in accordance with these Terms.

2. Merchant Responsibilities & Anti-Spam Policy

By using PixelHub, you agree to comply with all applicable anti-spam laws, including the CAN-SPAM Act and the GDPR.

  • Explicit Consent: You may only import and send emails to subscribers who have explicitly opted-in to receive marketing communications from your business.
  • Prohibited Content: You may not use PixelHub to send illegal, abusive, harassing, or deceptive content.
  • Account Suspension: We reserve the right to suspend or terminate your account immediately, without refund, if we determine you are sending unsolicited spam, generating excessive bounce rates, or violating our Anti-Spam Policy.

3. Data Processing Agreement (DPA)

By uploading your customer data to PixelHub, you instruct us to process that data solely for the purpose of sending your email campaigns. You represent and warrant that you have the legal right and necessary consents to share this data with us. PixelHub will implement reasonable security measures to protect this data.

4. Payments and Subscriptions

PixelHub is a paid, subscription-based service.

  • By subscribing, you authorize our payment processor (Stripe) to charge your payment method on a recurring basis.
  • You may cancel your subscription at any time. Cancellations will take effect at the end of your current billing cycle. We do not offer prorated refunds for partial months.

5. Limitation of Liability

PixelHub is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, PixelHub and Peer Schmitz shall not be liable for any indirect, incidental, or consequential damages, including lost profits, lost revenue, or data loss resulting from your use of the Service, software downtime, or emails failing to reach the inbox.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain. Any disputes arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the courts of Santa Cruz de Tenerife, Spain.
